San Diego Procedures During Pandemic of 2020

All cases filed through October 10, 2020, will be conducted by telephone or video. In some cases, the trustee may require another hearing after the telephone or video one and that may be in person if the trustee requires it.

When you file the case calendar these items:  Financial Management, receipt of Driver’s License & SS Card, upload Declaration confirming ID &  SSN, 341a upload questionnaire, send client call-in number and passcode, find out if the trustee is using telephone or Zoom

When you file the case you are already (pre-pandemic) sending these documents to the client:

  1. Confirmed copy of the petition
  2. The supporting documents
  3. Bankruptcy Information sheet
  4. 341a Meeting of Creditors Questionnaire

Under the pandemic rules, when you file, also send the client:

6.  If you don’t already have it, request for Driver’s License and Social Security card.

A few days after you file the case you’ll receive the Notice of Chapter 7 Bankruptcy case.  On the Notice of Chapter 7 Bankruptcy case, there is a call-in number and passcode.  Give that info to the client before the hearing.  Some trustees (eg Kennedy) prefer to use Zoom instead of the phone.  Send an email to the trustee and ask him which procedure he plans on using.  Make sure the client knows how to use Zoom.

Additional documents attorney must upload (in addition to supporting documents):

1.  Declaration Confirming Identity and Social Security Number for Telephonic §341(a) Meetings

(the declaration is also available as a local form in Best Case.)  You must attach a copy of the California Driver’s License and Social Security Card to the Declaration Confirming Identity and Social Security Number for Telephonic §341(a) Meetings. The attorney must sign or initial the copy of the California Driver’s License and Social Security Card.
