What Is Bankruptcy?
Bankruptcy is a legal process in which an individual, married couple, or business obtains court-ordered relief from some or all of their debts. This process allows both the creditor(s) and debtor(s) involved to come to a mutual, court-ordered agreement that will allow debts to be forgiven or paid in a manner that works for everyone.
I can help you file for:
- Chapter 7 Bankruptcy. As the fastest and simplest form of bankruptcy, Chapter 7 typically allows filers to obtain a debt discharge within as few as six months. If you can protect all your property from liquidation (which is the case for most people who file Chapter 7), you can receive this discharge without losing anything you own.
- Chapter 13 Bankruptcy. Individuals typically file Chapter 13 if they have a steady income and more assets than they could protect from the Chapter 7 liquidation process. Under Chapter 13, you will make monthly payments to the trustee for three to five years, and then the court will discharge any remaining debts.
Each chapter has its own set of advantages, disadvantages, and requirements, which is why I will take as much time as necessary to help you assess your options and determine which approach is right for you.
